A US federal appeals court has rejected the Trump administration's attempt to stop California from counting the ballots of 20,000 registered voters. The justice department claims these voters are non-citizens.
The court ruled 2-1 on Monday against Donald Trump's justice department. The judges denied the administration's demand that election officials separate the thousands of ballots until the people on the list could prove their citizenship.
The justice department had given the California secretary of state 48 hours to carry out the order. State election officials refused, which led to the lawsuit.
California Governor Gavin Newsom accused Trump of an "assault on democracy" over the move.
